General Terms of Service (TOS)

1. Scope and Acceptance

Use of the FlowVio platform ("the Service") implies full and unreserved acceptance of these terms. These provisions govern the contractual relationship between FlowVio and any professional entity ("the User") wishing to benefit from our management tools. Continued access to the Service constitutes acceptance of any updates to these terms.

2. Nature of Service and Scalability

FlowVio provides a SaaS (Software as a Service) infrastructure dedicated to optimizing business management (invoicing, inventory, CRM). With a view to constant improvement, FlowVio reserves the right to evolve the features, interface, or technical infrastructure of the Service, striving to minimize any impact on the User's operational experience.

3. User Responsibility and Compliance

The User retains full control and exclusive responsibility for their use of the Service. In this regard:

Tax and Legal Compliance: While FlowVio offers tools to facilitate management, the User remains solely responsible for the compliance of their invoices, accounting, and tax filings with the laws in force in their jurisdiction. FlowVio shall not substitute for a chartered accountant or tax advisor.
Access Security: Login credentials are strictly personal. Any action performed via the User's account is deemed to have been carried out by the User.

4. Availability and Service Continuity

FlowVio is subject to an obligation of means regarding the availability of the Service. We implement the highest industry standards to ensure 24/7 access. However, the User acknowledges that technical contingencies inherent to the Internet and necessary maintenance operations may occasionally result in temporary interruptions, for which our liability shall not be engaged beyond any service guarantees specifically subscribed to.

5. Intellectual Property

All elements constituting the Service (source code, algorithms, design, structural databases) remain the exclusive property of FlowVio. The User benefits from a personal, non-transferable, and non-exclusive right of use for their internal needs. The User remains the sole owner of the commercial data (customers, products, sales) integrated into the platform.

6. Limitation of Liability

To the extent permitted by law, FlowVio's global liability for any proven direct damage is expressly limited to the amount actually paid by the User for use of the Service during the twelve (12) months preceding the generating event. FlowVio disclaims all liability for indirect damages, such as loss of profit, loss of customers, or loss of data resulting from non-compliant use or force majeure.

Privacy Policy and Data Protection

The protection of your digital assets and personal data constitutes the cornerstone of our ethical commitment. This Privacy Policy details with transparency the technical and legal modalities under which FlowVio (hereinafter "the Processor" or "We") collects, processes, and secures data on behalf of its Users (hereinafter "the Controller").

The User (You): Acts as the "Data Controller" regarding the data of your own customers, employees, and inventory inserted into the platform. You alone determine the purpose of this data.
FlowVio (We): Acts as the "Data Processor". We process data exclusively on your documented instructions (through use of the Service) and for the sole needs of contractual execution.

2. Comprehensive Typology of Collected Data

To ensure optimal delivery of the Service, we process the following categories of information:

Administrative Data (Know Your Customer): Identity of legal representatives, tax information (TIN/VAT), bank details (IBAN/BIC) via our secure payment providers, and billing contacts.
Operational Data (Business Data): All information flows generated by your use: item databases, inventory movements, customer files, employee performance metrics, and sales logs.
Telemetry and Security Data: Connection IP addresses, device digital fingerprints (User-Agent), event logs for security auditing, and technical session cookies.

3. Purposes and Legal Basis for Processing

Each data processing operation carried out by FlowVio rests on a specific legal basis:

Contractual Execution: Data collection is strictly necessary for software provision (account access, invoice generation, inventory calculations).
Legal Obligation: Retention of accounting documents and connection logs in accordance with prevailing legislation (fraud prevention, judicial requisitions).
Legitimate Interest: Anonymized statistical analysis aimed at improving algorithms, preventive detection of cyber-threats, and corrective maintenance.

4. Security Architecture and Hosting

FlowVio applies a "Security by Design" policy. Your data is not merely stored; it is fortified:

5. Subsequent Subprocessing and Transfers

FlowVio relies on an ecosystem of rigorously audited technology partners (Cloud providers, transactional email services). We guarantee that each subsequent subprocessor complies with security standards equivalent to or higher than ours. No data transfer outside jurisdictions offering an adequate level of protection is performed without appropriate legal safeguards (Standard Contractual Clauses).

6. Retention and Reversibility (Right to be Forgotten)

Your data is kept for the duration of your subscription, increased by the legal limitation periods. At the end of the contractual relationship, or upon express request for account closure:

You have a right to reversibility: full recovery of your operational data in standard open formats (CSV, JSON, PDF).
After a technical grace period (security backups), data is permanently purged from our active systems.

1. Edition and Operation of the Service

This site and associated SaaS services (hereinafter collectively referred to as "the Platform" or "the Service") are edited and operated by the entity holding the relevant intellectual property rights (hereinafter "the Publisher"). The entire set of elements constituting the Platform is subject to international legislation on copyright, trademark law, and generally, on intellectual property. These elements include, but are not limited to:

Software Architecture: Source code (backend and frontend), calculation algorithms, database structures, and proprietary APIs.
Visual Identity: Graphic charter, logos, icons, animations, layout (UI/UX), and typographic elements.
Editorial Content: Texts, technical documentation, blog articles, and integrated training materials.

Any representation, reproduction, modification, distortion, extraction, or total or partial exploitation of the Platform, by any process whatsoever and on any medium whatsoever, without the express prior authorization of the Publisher, is strictly prohibited and would constitute an act of infringement sanctioned by applicable intellectual property codes.

3. Hosting and Technical Infrastructure

Data hosting and technical infrastructure are provided by world-class Cloud service providers, certified according to the strictest security standards (including ISO/IEC 27001, SOC 2 Type II). These infrastructures guarantee physical and logical data security (access control, power redundancy, anti-DDoS protection).

The Publisher implements a rigorous security policy, including encryption of communications (TLS) and sensitive data, in order to preserve the confidentiality and integrity of processed information. However, the User acknowledges that data transmission over the Internet involves inherent risks related to the very nature of the network.

4. Warranty Limitation and Technical Liability

The Platform is provided "as is" and "as available". The Publisher is subject to a general obligation of means regarding Service accessibility. Consequently:

The Publisher does not guarantee that the Service will be free of anomalies, errors, or bugs, nor that these can be corrected, nor that the Service will function without interruption or failures.
The Publisher reserves the right, at any time and without notice, to temporarily suspend access to all or part of the Service for technical reasons (maintenance, updates, migration) or security reasons, without this giving rise to any compensation.

The Publisher disclaims all liability for direct or indirect damages (financial losses, commercial prejudice, data loss) resulting from the use or inability to use the Platform, or fraudulent access by a third party to computer systems.

5. Applicable Law and Jurisdiction

These Legal Mentions, as well as any question related to use of the Platform, are governed by the law of the Publisher's principal place of business. In case of dispute, and after failure of any attempt to find an amicable solution, express jurisdiction is attributed to the courts within the jurisdiction of this same place of establishment, notwithstanding plurality of defendants or impleader.
